A recent change to the status of nickel and other chemicals under the California law known as Proposition 65 has triggered a review of aGROair’s compliance with this regulation.
California Proposition 65 (also known as Prop 65) has been in existence since the 1980’s. Originally it was a ballot initiative that was to protect the ground water in that State, but it has since transformed into a more generalized system to protect California consumers from chemicals that the State of California has deemed hazardous either as a cancer-causing agent or reproductive harm or both.
It is important to know that this regulation does not limit the use of any of these chemicals per se (for instance a number of them are prescription medicines), but rather if a product is offered for sale in California it is required to warn the consumer of their presence. Also important - the regulation makes no stipulation of the amount of the chemical that may be contained in the product nor does it distinguish in the likelihood of exposure. If the chemical is present in any concentration (some chemicals have lower limits, but these are extremely low) then the warning(s) must be presented.
Because aGROair products are distributed nationwide, and most often aGROair does not know the ultimate delivery address; aGROair will be providing the prescribed labeling on all of our products both on the product itself and on the exterior of our packaging. aGROair is also placing the warning on our printed literature and on product information on our website.
To our distributors and representatives - it is important that you also provide the warning on your advertising, website, and product information.
